General terms of use

General provisions

In regulating their mutual relations, the contracting parties shall be guided by the laws and other legislation of the Republic of Estonia and by the conditions agreed within these terms of use.

Parties to the transaction

Seller: Dagö Berry OÜ (registry code 12454829, Hiiumaa parish, Hagaste village, 92332 Hiiu County, phone +372 6625066,
Buyer: a natural or legal person who, before executing a transaction and while using the product(s), confirms that he/she has read the terms and conditions and agrees and undertakes to comply with them.

Product prices, availability and product information

The product photos displayed on the product information page are for illustrative purposes only and may differ from the actual appearance of the product.

The prices of all goods sold in the e-store are in euros and include the VAT valid in the Republic of Estonia at the time of the sales and purchase transaction. A transport fee is added to the prices.

Prices are valid from the time the order is placed until the expiry of the placed order’s payment due date (7 days after placing the order).

If the order has been submitted before the terms of sales or prices were changed, the conditions valid at the time of placing the order shall be adjusted to the legal relations between the Buyer and Dagö Berry OÜ.

The Seller has the right to make changes to the e-store services at any time, without the obligation to notify the Service user in writing.

The Seller of the goods has the right to withdraw from the order in the event of a technical error, due to which the price of the product in the e-store was incorrect. If the customer is notified before or after submitting the customer’s order and Dagö Berry OÜ and the customer do not reach an agreement on a new price, Dagö Berry OÜ has the right to withdraw from the sales transaction, cancel the customer’s order and return the amount paid for the order.

If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the Buyer will be notified as soon as possible, the time of arrival of
new goods will be announced, a replacement product will be offered or the Buyer will be refunded.

If, after payment for the Goods by the Buyer, it turns out that the Goods requested by the Buyer are out of stock, the Buyer has the right to receive a refund for the product.

To receive the goods, the buyer has the following options:

  • Itella Smartpost parcel machine
  • Itella Smartpost courier
  • Omniva parcel machine

Shipping costs are borne by the Buyer and the corresponding price information is displayed next to the shipping method. The delivery fee depends on the location of the Buyer and the chosen delivery method. The transport cost is displayed to the Buyer when placing the order when the exact weight and volume of the goods are known.

Orders submitted and paid on working days before 14.00 will be shipped the next working day at the latest. Depending on the chosen delivery method, you will usually receive the goods within 2-5 working days. In the Estonian islands, delivery may take up to 7 days. Outside Estonia, the goods are delivered depending on the destination. The goods will be shipped on the next working day after the Buyer has paid the invoice. If the shipment is delayed for any reason, Dagö Berry OÜ customer support will agree with the Buyer on another suitable delivery time.

Placing an order, concluding a sales and purchase transaction

To order, the Buyer has the opportunity to create a user account at or place an order without creating one. Creating a user account in our environment allows the Buyer to participate in our customer program and to receive informatiob about the best offers and campaigns.

To order the goods, you must add the desired products to the shopping cart. You can see the shopping cart by clicking on the “Shopping cart” button in the header of the website and proceeding to the shopping cart page.

The shopping cart shows all the products added to it as a list, where the desired quantity (pcs) and price are displayed for each product. You can also see the total cost of the cart.

To place an order, please fill in the required fields and select the appropriate delivery method. If you want to send the parcel to someone else, please activate delivery to another address and enter the details of the parcel’s recipient.

When confirming the order, an order form will be issued, which you can pay for immediately by a bank link or a bank transfer. A copy of the confirmed order will also be sent to your email address in case you wish to pay for the order later.

The Buyer’s Goods are assembled in the Seller’s warehouse only after the payment for the Goods.

NB! When paying with a bank link, make sure you click on the “Back to merchant” button on the bank’s page.

Payments are mediated by Montonio Finance UAB. Payment takes place outside the e-store in a secure environment – when paying with a bank link in the secure environment of the respective bank as well as when paying with a credit card in the secure environment of Montonio Finance UAB.

The Seller does not have access to the customer’s bank and credit card details. The Agreement enters into force upon receipt of the amount due to the current account of the e-store. The owner of the e-store is the data controller of personal data and forwards the personal data necessary for making payments to the authorised processor Montonio Finance UAB.

Delivery and shipment of goods

After the sales contract enters into force (Customer pays for the order), Dagö Berry OÜ completes the order and hands it over to the selected logistics partner for delivery.

Orders placed and paid for before 14.00 on working days will be shipped the next working day at the latest. Depending on the chosen delivery method, the goods will reach their destination within 2-5 working days. In the Estonian islands, delivery may take up to 7 days. Outside Estonia, the goods will be shipped on the next working day after the buyer has paid the invoice and the exact delivery time of the goods depends on the destination. If the shipment is delayed for any reason, Dagö Berry OÜ customer support will agree upon an alternative delivery time with the Buyer.

The delivery terms indicated above are valid from the moment the order has been paid for.

To receive your goods on time, please pay attention when entering the delivery details while placing the order.

Shipments where the product/s have been damaged during transport (not the product packaging) will be replaced by the Seller. If replacement proves impossible, we offer compensation for the cost of the damaged goods.

Dagö Berry OÜ is not responsible for any delay in the delivery of the goods if the goods have been handed over to the logistics partners on time for delivery to the Customer, but the delay in delivery is due to circumstances that Dagö Berry OÜ could not influence or foresee.

Cancelling the order

If the delay in the delivery of the Goods to the destination or other related misunderstanding is due to the inaccuracy of the information provided by the Buyer when placing the order, the Seller shall not be liable for such delay and the Buyer shall not have the right to withdraw from the sales contract.

If the Buyer is not present at the time previously agreed upon with the Supplier or due to other circumstances depending on the Buyer, the Seller has the right to issue
a separate invoice for the transport for delays or multiple deliveries.

The Buyer has the right to withdraw from the sales and purchase agreement in case the sales and purchase transaction has been concluded between the Buyer and the Seller, but delivery of the Goods to the destination specified by the Buyer is delayed due to the Seller exceeding the delivery term specified in the Terms and Conditions.

The Buyer has the right to withdraw from such an agreement within 1 working day from the Seller becoming aware of the delay of the Goods and the reasons thereof, by submitting a corresponding withdrawal application to the Seller in a means that leaves a written record.

If you are not satisfied with the quality of the delivered goods and want to return or replace them, please notify us no later than 72 hours after delivery by e-mail or by phone +372 6625066.

The Seller is not responsible for defects in the goods if:
Complaints about food products are submitted later than 72 hours after delivery.

The Seller is not responsible for any defects in the product caused by the Buyer which have occurred as a result of improper storage or improper use. The claim must state the exact description of the non-conformity or defect of the product. The Seller is not responsible for any defects in the product if the “Best before” date of the goods has passed whilst in the possession of the customer.​
The e-Store is not responsible for defects that have occurred after the delivery of the goods to the Buyer.

If the goods purchased from the e-store have defects for which the e-store is responsible, the defective goods will be repaired or replaced. If the goods cannot be repaired or replaced, the e-store will return all costs associated with the sales contract to the Buyer.

In order to exercise the 72 hours right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.

Pursuant to § 53 (4) of the Law of Obligations Act, it is not possible to return products that have been: damaged or ruined by the Buyer (incl. original packages of damaged or opened products); products which are perishable or which have reached their “Best before” date after receipt by the purchaser.

To return the goods, an application for purchase withdrawal must be submitted and sent to the e-mail address: no later than within 72 hours of receipt of the goods.

Returned Products must be unused and undamaged, i.e., in the original packaging. Testing of the Product shall not be deemed as use of the Product if the Product has been inspected to verify its nature, characteristics and functioning in the manner permitted for testing the goods in a physical store. If the Products have been used for purposes other than the activities necessary to verify their nature, characteristics and functioning or if there are indications of use or wear, the product shall not be replaced. If you have opened the packaging of the Product, we will only replace the
Products if they are damaged or of poor quality. The goods will be returned at the expense of the Customer and the initial transport cost will not be reimbursed (unless the returned goods do not correspond to the ordered one).

Upon receipt of the returned goods, the e-store shall return to the Buyer immediately, but not later than 72 hours after the receipt of the withdrawal application, all fees received from the Buyer on the basis of the contract.

The e-store may refuse to make refunds until the item that is the subject of the contract has been returned or until the Buyer has provided proof that he/she has returned the item, whichever is earlier.

The right of withdrawal does not apply if the Buyer is a legal person.​
The e-store responds to the consumer’s complaint in writing within 72 hours.


If Dagö Berry OÜ violates its obligations, the Customer has the right to demand the fulfilment of the obligation, refuse to perform its due obligation, demand
compensation for damage, price reduction, interest on delay in fulfilling the financial obligation or withdraw from the contract.

The Seller is not liable for damages caused by improper use of the ordered goods.

All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than within 72 hours from the receipt of the complaint.

If Dagö Berry OÜ has refused to resolve the Customer’s complaint or the Customer does not agree with the solution offered by Dagö Berry OÜ and finds that his/her rights or interests have been violated, the Customer may submit a complaint to the Consumer Complaints Committee through the Consumer Protection Board or to a court. The consumer may lodge a complaint him/herself or through a representative. The information of the Consumer Protection Committee can be found on the website of the Consumer Protection Board in order to solve problems arising in the Member States of the European Union, contact the European Consumer Center.
